To whom does the unemployment fund disclose personal data?
The unemployment insurance fund discloses personal data to the following recipients in the exercise of its official functions and per its legal obligations:
- Your new unemployment insurance fund receives information about your membership and, if you apply for benefits, some details about the conditions for receiving benefits from the unemployment insurance fund. See Section 48 e of the Unemployment Insurance Act (1997:238) (ALF) and Section 25 of the Unemployment Insurance Ordinance (1997:835) (FALF).
- Information is provided to the Social Insurance Agency on whether you are entitled to benefits and to what extent, your possibilities of working, potential obstacles to benefits, and whether benefits have been paid from the unemployment insurance fund. See § 48 d ALF and § 24 FALF.
- Under Section 48 d ALF and Section 24 a FALF, the unemployment insurance fund is obliged to disclose information to the Pensions Agency.
- Information is provided to the Public Employment Service on the number of benefit days paid and the entitlement to and extent of continued benefits from the unemployment insurance fund. See § 48 b ALF and § 21 FALF. The municipal social committees are informed whether you are entitled to benefits, to what extent, and whether benefits have been paid from the unemployment insurance fund. See Chapter 11, Section 11 of the Social Services Act (2001:453), and Section 4 of the Ordinance (2008:975) on the obligation to provide information in certain cases under the Social Services Act.
- Regulation (EC) No 987/2009 of the European Parliament and of the Council implementing Regulation (EC) No 883/2004 on the coordination of social security systems requires member states to exchange information electronically. We disclose information on completed periods of insurance and work if a member or former member has applied for unemployment benefits in another member state. We can disclose information on decisions to recover unemployment benefits and request offsetting of debts against benefits paid in another EU or EEA country.
- The Enforcement Authority is provided with information on days of benefit from the unemployment insurance fund and payment of such benefits. See Chapter 4, Section 15 of the Enforcement Code (1981:774) and Section 25 b of the FALF. When unemployment benefits have been paid incorrectly and the benefit is not repaid, the unemployment insurance fund may turn to the Enforcement Authority for collection. The unemployment insurance fund may also turn to the district court to have a claim established.

Information about membership and benefits is submitted to Statistics Sweden for statistics. See section 94 b of the Unemployment Funds Act (1997:239) (LAK) and section 7 of the Unemployment Funds Ordinance (1997:836) (LAKFo).

Information is provided to the Migration Agency, the Swedish Social Insurance Agency, the Swedish Pensions Agency, the Central Board of Student Finance, the Public Employment Service, the municipalities, or other unemployment funds if the unemployment fund finds reason to assume that a financial benefit has been decided or paid out incorrectly in the other organization's activities. See the Act (2008:206) on the duty to notify in the event of incorrect payments from welfare systems.

The Swedish Tax Agency, the Swedish Pensions Agency, and the General Administrative Court are provided on request with information on circumstances significant for implementing the Income-based Retirement Pensions Act. See Chapter 15, Section 13, second paragraph of the Income-based Retirement Pensions Act (1998:674).
- Control information for interest expenses is submitted to the Swedish Tax Agency. The unemployment insurance fund also submits an employer's declaration at an individual level to the Tax Agency. This means that the unemployment insurance fund reports payments and tax deductions monthly. See Chapter 26 of the Tax Procedure Act (2011:1244), SFL.
- The unemployment insurance fund is obliged under the Contributions Fraud Act to report suspected contribution fraud to the Police Authority or the Public Prosecution Service.
- The Unemployment Insurance Inspectorate (IAF) can request the unemployment insurance fund to disclose information in individual cases in the event of audits and complaints.
- The unemployment insurance fund provides information to the administrative courts, the administrative courts of appeal, and the Supreme Administrative Court regarding appealed cases.
- To the Parliamentary Ombudsman in the event of complaints about the unemployment fund's handling of cases.
- To the Chancellor of Justice in the event of complaints and requests for damages due to the unemployment fund's handling.
- To the National Council for Crime Prevention for statistical purposes.
- To the National Audit Office for its audits.
- In the event of a personal data breach, the unemployment fund may need to provide the Data Inspectorate with information on what data has been disclosed and to whom.
In addition to the data that the unemployment insurance fund discloses due to a legal obligation or that is necessary to pay unemployment benefits, the unemployment insurance fund only discloses data when the individual has consented to it or when it is necessary to be able to fulfill its obligations to manage unemployment insurance.
The unemployment insurance fund discloses data to Swedbank to be able to pay compensation to those who have applied for compensation from the unemployment insurance fund.
Information about your right to compensation is also provided to the Job Security Council, the Transition Fund, and the Job Security Foundation.
From which actors can the unemployment fund receive data about you
We usually receive personal data from you when you apply for membership or unemployment benefits. When permitted by law and necessary for the assessment of your entitlement to benefits, the unemployment fund collects the following information.
- Information on registration as a job seeker, participation in programs, and information on establishment allowance from the Public Employment Service under Section 48a ALF and Section 20 FALF.
- Information on compensation or other support from the Swedish Social Insurance Agency per Section 48c ALF and Section 22 FALF.
- The unemployment insurance fund saves questions from the Social Insurance Agency about temporary parental allowance to check whether the individual would apply for benefits for the same period in the future.
- Information on pension or other benefits from the Swedish Pensions Agency per Section 48c ALF and Section 22a FALF.
- Information on applied for and granted student aid from the Central Board of Student Aid (CSN) per § 48c ALF and § 23 FALF.
- Information on income from the Swedish Tax Agency's taxation database for calculating and checking unemployment benefits per Section 8 d of the Ordinance (2001:588) on the Processing of Data in the Tax Agency's Taxation Activities.
- If you terminate your membership of one unemployment insurance fund to join another, your new unemployment insurance fund will collect certain information from your old unemployment insurance fund per section 48e of the ALF and section 25a of the FALF.
- The Migration Agency, the Swedish Social Insurance Agency, the Swedish Pensions Agency, the Swedish Tax Agency, the Swedish Enforcement Authority, the Swedish Board of Student Finance, and the Swedish Public Employment Service are obliged by law (2008:206) to notify the unemployment insurance fund if they believe that a financial benefit has been decided or paid incorrectly or in an excessive amount by the unemployment insurance fund.
- If you apply to look for work in another EU country, the Unemployment Insurance Inspectorate (IAF) will take a decision on the matter, which will then be passed on to the unemployment insurance fund. If you then apply for benefits from another EU country, the unemployment insurance fund will receive information about your application at the employment office in that EU country.
- The Swedish Enforcement Authority can provide information to the unemployment fund about any payment orders, attachments, or debt rescheduling. This information is used by the unemployment insurance fund to manage its claims per good debt collection practices.
- Regulation (EC) No 987/2009 of the European Parliament and of the Council implementing Regulation (EC) No 883/2004 on the coordination of social security systems requires member states to exchange information electronically. We collect information on completed periods of insurance and work in another EU or EEA country if you need to take periods into account when applying for unemployment benefits. We can obtain information on ongoing payments of social security benefits in other EU or EEA countries and request offsetting of debts against benefits paid in another EU or EEA country.
- The unemployment fund obtains your civil registration data from SPAR, the National Personal Address Register.
